2008 Key to Your Heart Sweepstakes Official Rules January 1, 2008 - December 31, 2008
1. NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS SWEEPSTAKES. Sweepstakes begins 12:00 AM PST January 1, 2008 and ends 11:59 PM PST December 31, 2008. Sponsored by The Brass Key, Inc., P.O. Box 4009, Federal Way, WA 98003 ("Sponsors"). For purposes of these Official Rules, times are Pacific Standard Time (PST).
2. ELIGIBILITY. Sweepstakes is open to all legal residents of the fifty (50) United States and the District of Columbia ("U.S."), eighteen (18) years of age and older as of October 1, 2003. The sweepstakes is intended for viewing and participation only in the fifty (50) United States and District of Columbia, and shall be governed according to the laws of the United States. VOID IN PUERTO RICO, THE U.S. VIRGIN ISLANDS, U.S. MILITARY INSTALLATIONS IN FOREIGN COUNTRIES AND ALL OTHER U.S. TERRITORIES AND POSSESSIONS AND WHERE PROHIBITED OR RESTRICTED BY LAW. Employees, agents and representatives of Sponsors, their advertising and promotion agencies, and any entity involved in the development, production, implementation, administration or fulfillment of this Sweepstakes and their immediate family members and individuals living in the households are not eligible to participate or win. Only one winner per household. The Sweepstakes is subject to all applicable federal, state, and local laws and regulations. All decisions of the Sponsors with respect to this Sweepstakes are final.
3. ENTER BY INTERNET. There is one way to enter the Key to
Your Heart Sweepstakes, Registered BK Collector's Club Members may
enter the Sweepstakes by visiting The Brass Key at www.brass-key.com
clicking on the Key to Your Heart Sweepstakes button or by going directly
to the Sweepstakes
entry page, enter their Collector ID and Password and click on
the "submit" button. Visitors must first register at www.brass-key.com
before they can enter the Sweepstakes. To register for free at Brass
Key, visitors must complete the Registration
Form. After registering, follow the instructions above to enter
the Sweepstakes. There will be three (3) Monthly drawings for this
Sweepstakes (one per month). Entries for the Monthly Prize Drawings
must be received by the dates and times described in the outlined

In the event of a dispute about the identity of an entrant, each entry will be declared made by the authorized account holder of the email address submitted at time of entry. Authorized account holder is defined as the natural person who is assigned to an email address by an Internet Service Provider, online access provider or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. With respect to the winning entry, the winner may be required to provide proof that the winner is the authorized account holder of the email address associated with the winning entry. All prizes will be awarded, provided a sufficient number of eligible entries are received.
E-MAIL CHANGE OF ADDRESS POLICY: It is the sole responsibility
of the entrant to notify Sponsor if the entrant changes his or her
e-mail address. Send an e-mail to customerservice@brass-key.com
with your member name, old e-mail address and new e-mail address.
4. SELECTION OF WINNERS. Three (3) Monthly Prize winners will
be selected in total (one for each month) at random by Sponsor's Administrator,
from all eligible entries received by the dates specified in the Monthly
Prize Drawing Schedule below. Each correct and valid entry will only
be eligible to win one prize per month. The random drawing will be
held under the supervision of Sponsors, whose decisions shall be final

5. PRIZES. Each month there will be one (1) winner who will receive a prize chosen from Brass Key's collection as designated in the Prize schedule below. All prizes shall be shipped by Brass Key to winner, all shipping fees to be paid by Sponsor. Odds of winning depend on the number of eligible entries received. Taxes are the sole responsibility of the winner, where applicable.

i. Prize Restrictions: No assignment, transfer or substitution of prizes is permitted. Nor may prizes be substituted for cash. ii. Prize Claims: Selected entrants will be notified by postal mail and may be required to complete, execute and return an affidavit of eligibility and liability/publicity release ("Affidavit"). Failure by a selected entrant to sign and return any such forms within 14 days of delivery to his or her address via UPS 2nd Day Air (to be sent to the winner by Sponsors) or the return of notification, prize information or the prize as undeliverable may result in a disqualification of the selected entrant as a potential Prize Winner. Upon any such disqualification, an alternate sweepstakes entrant shall be selected by random drawing conducted by Sponsors. Acceptance of any prize constitutes the prize winner's permission to use such person's name, picture, likeness and address for promotional or advertising purposes in connection with this Sweepstakes without further compensation or permission except where prohibited by law. Entries become the property of the Sponsor and will neither be acknowledged nor returned. All entries are subject to verification prior to awarding of prizes
6. ODDS OF WINNING. MANY WILL ENTER. FEW WILL WIN. Odds of winning a Monthly Prize depend on the eligible number of entries received for each drawing.
7. RESTRICTIONS. Monthly prizes consist of only those items specifically described as part of the prize. Sponsor will not replace any lost or stolen prize items once in the winner's possession. If prize cannot be awarded due to circumstances beyond the control of the Sponsor, a substitute prize of equal or greater retail value will be awarded. Sponsor shall not be liable to winner or any person claiming through winner for failure to supply the prize or any part thereof, by reason of any acts of God, any action(s), regulation(s), order(s) or request(s) by any governmental or quasi-governmental entity (whether or not the action(s), regulations(s), order(s) or request(s) prove(s) to be invalid), equipment failure, terrorist acts, air raid, blackout, act of public enemy, earthquake, war (declared or undeclared), fire, flood, epidemic, explosion, unusually severe weather, hurricane, embargo, labor dispute or strike (whether legal or illegal) labor or material shortage, transportation interruption of any kind, work slow-down, civil disturbance, insurrection, riot or any other cause beyond Sponsors' sole control (collectively, "Force Majeure Event").
8. LIMITATIONS OF LIABILITY: THE FOLLOWING TERMS & CONDITIONS APPLY: Sponsor does not assume any responsibility for incorrect or inaccurate capture of entry information, including but not limited to technical malfunctions, human or technical error, seeding or printing errors, lost/delayed/garbled data or transmissions, omission, interruption, deletion, defect or failures of: any telephone or computer line or network, computer equipment, software or any combination thereof. Entry materials/data that have been tampered with or altered are void. In the event this Sweepstakes is compromised or becomes technically corrupted in any way, electronically or otherwise, Sponsor reserves the right to cancel, terminate, or suspend the Sweepstakes and in such event, to select winners for any remaining prizes by random drawing from among all valid entries received, up to such time of cancellation, termination or suspension. All entries become the sole property of Sponsor and will not be returned. By entering, participants release Brass Key, Inc. their respective directors, officers, employees, and agents from any and all liability for any injuries, losses, or damages of any kind caused by any prize or resulting from acceptance, possession, use, or misuse of any prize. Entrants agree to be bound by these Official Rules and the decision of the Sponsor's administrator.
9. OFFICIAL RULES AND WINNERS LIST. For a copy of the Official Rules or a list of the names of prize winners, send an self-addressed, stamped envelope within three (3) months of the conclusion of the Sweepstakes to: "Key to Your Heart Sweepstakes," Official Rules OR Winners List (please specify which), Brass Key, Inc., P.O. Box 4009, Federal Way, WA 98003. A list of the Winners will be posted online at http://www.brass-key.com each month, after prizes have been awarded, until 12/31/08.
10. DISPUTES: Any controversy or claim relating to this Sweepstakes not otherwise resolved between you and Brass Key will be settled solely by binding arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association ("AAA"), administered in accordance with the AAA's Supplementary Procedures for Consumer-Related Disputes. Any such controversy or claim will be arbitrated on an individual basis, and will not be consolidated in any arbitration with any claim or controversy of any other party. The arbitration will be conducted in Seattle, Washington, and judgment on the arbitration award may be entered into any court having jurisdiction of it.
11. POLICY CHANGES: Sponsor may find it necessary or be legally obligated to update these Official Sweepstakes Rules from time to time. Any changes will be posted at this site. Except as otherwise required by law, modifications to these Official Sweepstakes Rules will not affect the privacy of data collected by Brass Key, Inc. prior to the effective date of the policy change.
